1. Who these terms are between

Omnitik is operated by Transit International Tours and Travel, trading as Omnitik ("we", "us"). These terms apply between us and the business that opens an Omnitik account ("you"), and to every person you invite into that account.

By creating an account or using Omnitik, you accept these terms. If you are accepting on behalf of a company, you confirm you are authorised to do so.

2. What Omnitik does

Omnitik is a shared team inbox. It receives the messages your customers send you on WhatsApp, Instagram and Facebook Messenger, shows them to your team in one place, and sends your team's replies back on the same channel. It also assigns conversations to agents, applies your workflow rules, and reports on response times.

Omnitik is not a messaging platform of its own. It connects to the platforms you already use through their official APIs, using accounts and Pages that you own and connect yourself.

4. Connecting a channel

When you connect a WhatsApp number, an Instagram account or a Facebook Page, you confirm that you own it or are authorised to operate it on the owner's behalf. You can disconnect a channel at any time from the Integrations screen; for a Facebook Page this also unsubscribes our app from that Page's webhooks, so we stop receiving its messages.

5. Rules for using Omnitik

You must not use Omnitik to:

If a platform suspends or restricts your account for how you used it, that is between you and that platform. We will help where we can, but we do not control their decisions.

6. Your data

Your conversations and your customers' data remain yours. We process them to run the service, on your instructions — see the Privacy Policy for what we collect and why, and the data deletion page for how to have it removed.

We do not sell your data, do not use your conversation content for advertising, and do not use it to train machine-learning models.

7. Plans, payment and limits

Paid plans are billed in advance for the period shown on your invoice. Each plan carries limits — number of users, connected channels, and similar — which are shown in the product. Invoices are due within the period stated on them; we may suspend an account that remains unpaid after we have told you.

We may change prices with reasonable notice. A change takes effect at your next billing period, never mid-period.

8. Availability

We work to keep Omnitik available, but we do not promise uninterrupted service. Parts of it depend on third parties — Meta's APIs, our hosting provider — and those can fail outside our control. We schedule maintenance to be as unobtrusive as we can.

9. Ending the agreement

You can stop using Omnitik and close your account at any time. We may suspend or close an account that breaches these terms, or that puts the service or other customers at risk; except in urgent cases we will tell you first and give you a chance to put it right.

When an account closes, its data is deleted as described in the Privacy Policy. Export anything you want to keep before you close it.

10. Liability

Omnitik is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost data, and our total liability for any claim is limited to what you paid us in the twelve months before it arose.

Nothing here limits liability that cannot lawfully be limited.

11. Changes to these terms

If we change these terms we will update the date at the top, and we will tell account holders directly when a change is significant. Continuing to use Omnitik after that means you accept the change.

12. Governing law

These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have jurisdiction over any dispute.
